Using the Service

You must provide accurate account information, maintain the security of your account, and use ViralFrame only for lawful business or personal creative purposes. You are responsible for activity under your account.

Your content and permissions

You retain rights in content you submit, subject to the limited license needed for ViralFrame and its providers to host, process, and generate outputs for you. You represent that you have all rights, permissions, releases, and consents necessary for your uploads, prompts, trademarks, products, and claims.

Brand images, trademarks and authorized use

You are responsible for establishing a lawful basis for every brand name, logo, product photograph, copyrighted work, likeness and voice you submit or request. You must obtain any necessary licenses, permissions and releases before generation or publication. Uploading an image, receiving an output or passing an automated check does not grant ownership, a trademark license, brand approval or permission to imply sponsorship or endorsement.

You must not use another brand’s identity to impersonate it, falsely imply an affiliation, mislead viewers, infringe or dilute its rights, or associate it with unlawful, abusive or prohibited material. You are responsible for your prompts, uploads, instructions, edits, distribution and use of outputs, including any misuse by people you allow to access your account.

Image rights and video provider review

By submitting an image, logo, brand name, product photograph or other material, you represent and warrant that you own the necessary rights or have obtained the licenses, permissions and consents required for the intended generation and commercial use. Third-party video generation providers may reject an upload, decline or stop generation, or restrict an output under their intellectual property, safety or content policies, including where an automated system flags copyrighted or trademarked material.

Providing permission or evidence of ownership does not guarantee provider acceptance. A rejection is not a legal determination of infringement, and acceptance is not verification of your rights or legal clearance to publish. ViralFrame cannot guarantee or override a provider’s moderation decision. Use only material you are entitled to use, retain relevant authorizations, and review the applicable provider and publishing-platform policies before submitting or publishing content. Credit treatment remains subject to the Subscriptions and credits section below and applicable law.

Prohibited and inappropriate videos

You must not request, create, publish or distribute videos that violate our Acceptable Use Policy, including unlawful or infringing advertising, deceptive endorsements, fraud, threats, hateful or harassing content, sexual exploitation, non-consensual intimate content, sexual content involving minors, or material that endangers children. Do not use brand assets in such videos. Provider acceptance or an automated safety check is not legal clearance or permission to publish prohibited content.

AI outputs

Generated concepts, images, video, and audio can be inaccurate, unavailable, or similar to outputs created for others. You must review every output before publishing, particularly product claims, pricing, endorsements, regulated content, trademarks, and platform rules. ViralFrame does not guarantee that any output is unique, copyrightable, legally cleared, or suitable for a particular purpose.

Social promotion and performance

ViralFrame provides creative tools to help promote local businesses and build audiences on Instagram, TikTok, YouTube and other social platforms. References to viral or share-worthy content, reach or follower growth describe intended uses and do not constitute a promise of results. We do not guarantee virality, views, engagement, follower increases, bookings, sales, platform approval or distribution. Results depend on factors outside our control, including your content, audience and publishing-platform algorithms. You remain responsible for advertising disclosures, AI-content labels where required, and compliance with each platform’s rules. References to third-party platforms do not imply affiliation, sponsorship or endorsement.

Subscriptions and credits

Paid plans renew monthly until cancelled. The plan price, included credits, renewal interval, and applicable taxes are shown before purchase. Credits reset after each successful renewal, do not roll over, have no cash value, and cannot be transferred between accounts.

A 5-second video uses one credit and a 15-second video uses three credits. Credits are reserved when generation starts. If the video provider rejects the request before generation begins, the reserved credits are restored. Completed generations, user-requested re-renders, and provider work already performed are generally non-refundable except where required by law.

You can manage payment methods, invoices, plan changes, and cancellation through the Stripe customer portal. Cancellation takes effect at the end of the current paid period unless checkout states otherwise. Failed payments may pause generation access.

Restrictions

You may not reverse engineer the Service, evade usage limits, resell access without permission, use the Service to infringe rights, create deceptive or unlawful ads, process sensitive personal data without authorization, or generate content that violates our Acceptable Use Policy.

User misuse and indemnification

To the maximum extent permitted by applicable law, ViralFrame is not liable for claims, losses or damages arising from your unauthorized use of brand images or other third-party assets, your prohibited or inappropriate content, your breach of these terms, or your unlawful publication or distribution of outputs. You remain responsible for reviewing each video and correcting or withholding any output that is inaccurate, infringing, deceptive or prohibited.

To the extent permitted by law, you agree to indemnify and hold harmless ViralFrame and its personnel from third-party claims, liabilities, damages and reasonable legal expenses arising from your uploads, instructions, misuse of brand assets, prohibited content, distribution of outputs or breach of these terms. This obligation does not apply to the extent a claim results from ViralFrame’s own unlawful conduct or responsibilities that cannot lawfully be transferred. We will give you reasonable notice of a covered claim; you may not settle it in a way that admits liability for, imposes obligations on, or fails to release ViralFrame without our written consent.

Availability and limitation of liability

The Service and AI outputs are provided “as is” and “as available.” To the maximum extent permitted by law, ViralFrame disclaims implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and is not liable for indirect, incidental, special, consequential or lost-profit damages. To that same extent, our aggregate liability for the affected Service is limited to the amount you paid ViralFrame for it in the twelve months before the event.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability or statutory consumer right that applicable law does not allow us to exclude or limit. These terms do not prevent a regulator or rights holder from exercising legal rights against a party responsible for unlawful conduct.

Content enforcement and reporting

We may reject requests, remove or disable access to content, restrict generation, or suspend or terminate access for violations, subject to applicable law. Report suspected brand misuse, infringement or prohibited videos to support@viralframe.ai with the relevant project or content link and a description of the issue. Do not include unnecessary sensitive information.

Changes and contact

We may update the Service and these terms. Continuing to use ViralFrame after updated terms take effect means you accept them. If you do not agree, stop using the Service and delete your projects.
